Terms of service
All Sales Final
Due to the unique, limited, archived, vintage, collectible, promotional, personal, and/or one-of-a-kind nature of many items sold through 311 Vault, all sales are final.
We do not offer standard returns, exchanges, order cancellations, or refunds for change of mind, incorrect size selection, purchasing the wrong item, failure to review a product listing before purchase, personal preference, or other reasons unrelated to an error, damage, or fulfillment issue attributable to 311 Vault.
Exceptions may be considered only as described in these Terms and our Refund Policy, or where otherwise required by applicable law.
Nothing in these Terms is intended to limit or waive any rights or remedies that cannot legally be limited or waived.
1. Acceptance of Terms
By accessing, browsing, or purchasing from 311 Vault, you acknowledge that you have read, understood, and agree to these Terms of Service.
If you do not agree with these Terms, you should not use the website or place an order.
2. Eligibility and General Use
You must be at least 18 years old to place an order, or have the permission and involvement of a parent or legal guardian.
You agree to provide accurate, complete, and current information when placing an order or creating an account.
311 Vault reserves the right, where permitted by law, to refuse, cancel, limit, or review orders or access to the website when reasonably necessary, including in connection with suspected fraud, unauthorized activity, abuse of our policies, excessive or suspicious payment disputes, unauthorized resale activity, attempts to circumvent quantity limits, or other misuse of the website or ordering system.
3. Products and Availability
311 Vault may offer archived band inventory, limited-edition merchandise, vintage and collectible items, promotional materials, personal band items, signed items, discontinued products, and other unique or one-of-a-kind merchandise.
Because of the age, history, storage, and nature of certain items, products may exhibit normal or disclosed signs of wear, aging, discoloration, fading, storage marks, packaging wear, print imperfections, or other characteristics consistent with their age or history.
Where reasonably possible, material condition issues will be disclosed in the product description and/or photographs. Customers are responsible for reviewing the product description and available photographs before purchasing.
Product quantities may be limited, and 311 Vault may discontinue, modify, or remove products or listings at any time.
If an inventory discrepancy, technical error, or other issue results in an item being unavailable after an order is placed, 311 Vault may cancel the affected item or order. If payment has already been processed, the applicable amount will be refunded.
4. Product Images and Descriptions
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colors, condition information, and other product details are accurate.
Actual colors may vary depending on your display or device.
For one-of-a-kind, vintage, signed, or individually photographed items, the photograph may depict the exact item being sold. Minor variations may exist where photographs represent a particular example rather than the exact item shipped.
Customers should carefully review the product listing, photographs, size information, and condition information before completing a purchase.
5. Orders and Order Acceptance
Placing an order constitutes an offer to purchase the selected merchandise. An order is not considered accepted solely because it has been submitted or because payment has been authorized.
311 Vault may accept, cancel, refuse, or limit an order before shipment when reasonably necessary, including because of:
- Inventory discrepancies or technical errors
- Pricing or listing errors
- Suspected fraud or unauthorized activity
- Payment or billing issues
- Attempts to circumvent quantity restrictions
- Excessive or suspicious ordering activity
- Unauthorized resale or commercial purchasing
- Other circumstances requiring cancellation or order review
If an order is canceled after payment has been processed, the applicable amount will be refunded to the original payment method.
Orders generally cannot be canceled by the customer after checkout. Any cancellation requested after an order has been placed is entirely discretionary and is not guaranteed, particularly once the order has entered processing, packing, or shipment.
A shipment confirmation or other explicit order confirmation from 311 Vault constitutes acceptance of the order.
6. Pricing and Payment
All prices are listed in U.S. dollars unless otherwise stated.
Applicable shipping charges and taxes will be displayed during checkout.
Payment must be successfully completed before an order can be fulfilled.
311 Vault reserves the right to correct pricing, product, or listing errors. If an order is affected by a significant pricing or listing error, 311 Vault may cancel the affected order or item and refund any amount already paid for it.
7. Shipping and Delivery
Orders are generally processed within 2 to 3 business days unless otherwise stated on the product page.
Business days generally mean Monday through Friday, excluding U.S. federal holidays. Processing times may be longer during product launches, holidays, promotions, periods of unusually high order volume, or circumstances outside our reasonable control.
Estimated delivery times provided at checkout or elsewhere on the website are estimates only and are not guaranteed.
Once an order has been accepted by the applicable carrier, carrier delays, transportation interruptions, weather, service disruptions, or other events outside our reasonable control do not automatically create a right to cancel an order or receive a refund.
Additional shipping details and procedures are provided in our Shipping Policy.
8. Shipping Address Responsibility
Customers are responsible for providing a complete and accurate shipping address at checkout.
This includes orders placed using accelerated checkout or payment services such as Apple Pay, PayPal, Shop Pay, or similar services. Customers are responsible for reviewing the shipping address supplied by those services before completing the purchase.
311 Vault is not responsible for delays, failed delivery, misdelivery, return-to-sender situations, or additional shipping costs resulting from an incorrect, incomplete, outdated, or otherwise inaccurate address supplied by the customer.
If a package is returned to 311 Vault because of an incorrect or incomplete address, refusal, failed delivery, or another customer-related delivery issue, the available options will be handled according to our Shipping and Refund Policies.
9. Lost, Stolen, or Missing Packages
Once an order has been accepted by the shipping carrier, delivery and transit are subject to the carrier's handling and tracking systems.
If tracking indicates that a package has been delivered but the customer cannot locate it, customers should first check the delivery location, mailbox, building or mailroom, household members, neighbors, and any available carrier delivery information. Customers may also contact the carrier directly.
A package marked as delivered does not automatically qualify for a refund or replacement.
If a package appears to be lost in transit, customers should notify 311 Vault as soon as reasonably possible and, when applicable, may also contact the carrier. 311 Vault may assist with a carrier investigation or claim when appropriate.
Carrier confirmation that a package is lost does not, by itself, guarantee a refund or replacement. Any resolution will be determined based on the circumstances, available documentation, the item's availability, applicable carrier claims or insurance, and applicable law.
For one-of-a-kind, vintage, signed, or otherwise irreplaceable items, a replacement may not be possible.
10. Risk of Loss
Risk of loss, responsibility for merchandise during shipment, and related rights are determined according to applicable law.
Nothing in these Terms is intended to waive or limit any rights or protections that cannot legally be waived or limited.
11. Final Sale and No Standard Returns
All purchases are final.
Unless otherwise required by law or expressly approved by 311 Vault, we do not accept standard returns or exchanges and do not issue refunds for:
- Change of mind
- Incorrect size selection
- Purchasing the wrong item
- Failure to review a product description or photograph
- Personal preference
- Normal wear, aging, or characteristics disclosed in the listing
- Dislike of an item's appearance after purchase
- Carrier delays
- Packages marked delivered but not located by the customer
- Incorrect or incomplete shipping information supplied by the customer
- Refusal of delivery
- Other circumstances unrelated to an error, damage, or fulfillment issue attributable to 311 Vault
12. Exception Requests
Because all sales are final, any return, exchange, cancellation, refund, or other exception not otherwise required by law is discretionary.
An approved exception does not establish a precedent or create an ongoing right to similar exceptions.
If 311 Vault approves a discretionary return, the specific return conditions, shipping responsibility, refund amount, and any other applicable terms will be communicated to the customer before the return is completed.
Unless otherwise agreed, discretionary returns must generally be unused and returned in the condition received, with original packaging, accessories, tags, or other included materials where applicable.
311 Vault may deny an approved return request if the item is not returned in the required condition or if the customer does not comply with the return instructions.
13. Damaged, Defective, or Incorrect Items
If an order arrives damaged, defective, materially different from its listing, or contains an item that was incorrectly shipped by 311 Vault, customers should contact us as soon as reasonably possible, preferably within 48 hours of delivery.
Please provide:
- Order number
- Description of the issue
- Clear photographs of the item
- Photographs of the shipping package and label
- Photographs showing any visible damage or condition issue
Customers should not discard the item, packaging, shipping materials, or labels until 311 Vault has had an opportunity to review the issue.
We may request additional information or photographs before determining the appropriate resolution.
If 311 Vault determines that the issue is attributable to us, an appropriate remedy may include a replacement, refund, exchange, or other resolution at our discretion and as required by applicable law.
For one-of-a-kind, vintage, signed, or otherwise irreplaceable items, a replacement may not be available.
The preferred 48-hour reporting period is intended to help us investigate shipping and fulfillment issues promptly. It does not automatically waive any rights or remedies that cannot legally be waived.
14. Refunds
When a refund is approved, it will generally be issued to the original payment method used for the purchase.
Once a refund has been initiated by 311 Vault, the time required for the funds to appear in the customer's account may depend on the customer's bank, credit-card company, payment processor, or other financial institution.
Additional refund procedures are provided in our Refund Policy.
15. Intellectual Property
All website content, including logos, graphics, photographs, text, product descriptions, branding, and other materials displayed by 311 Vault, is owned by or licensed to 311 Vault and/or the applicable rights holders and may not be copied, reproduced, modified, distributed, or commercially exploited without appropriate authorization.
Purchasing a product does not grant the purchaser any ownership or license rights in 311 Vault, 311, or any related trademarks, copyrights, logos, photographs, or other intellectual property.
16. Prohibited Use
You agree not to use the website or its services to:
- Commit or facilitate fraud
- Circumvent quantity or purchasing restrictions
- Use unauthorized payment methods
- Submit false or misleading information
- Abuse refund, return, replacement, or shipping procedures
- Attempt unauthorized resale or commercial exploitation where prohibited
- Interfere with website functionality or security
- Access or attempt to access accounts, systems, or information without authorization
- Engage in any activity that violates applicable law
17. Fraud Prevention and Order Verification
311 Vault may use reasonable measures to protect customers, merchandise, and the business from fraud, unauthorized transactions, chargebacks, theft, and other abuse.
For certain orders, including high-value, limited-edition, signed, or one-of-a-kind items, 311 Vault may use additional verification, documentation, packaging, shipping, or delivery requirements when reasonably necessary to protect against fraud, loss, or unauthorized activity.
Orders may be delayed, reviewed, limited, or canceled when reasonably necessary for fraud prevention or order verification.
Nothing in this section requires 311 Vault to disclose internal fraud-prevention methods, screening criteria, security procedures, or loss-prevention practices.
18. Chargebacks and Payment Disputes
Customers agree to contact 311 Vault before initiating a payment dispute or chargeback when the issue concerns an order, shipment, refund, or other matter that may be resolved directly.
Initiating a chargeback does not override these Terms or automatically establish a right to a refund.
Where a payment dispute or chargeback is initiated, 311 Vault may provide the payment processor or financial institution with applicable order, payment, fulfillment, shipping, delivery, communication, and policy records in response to the dispute.
Nothing in this section limits a customer's rights under applicable law or the rules of the applicable payment network.
19. Limitation of Liability
To the maximum extent permitted by applicable law, 311 Vault will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of the website or purchase of merchandise.
To the maximum extent permitted by applicable law, 311 Vault's total liability arising from a particular order or transaction will not exceed the amount actually paid to 311 Vault for the merchandise giving rise to the claim.
Nothing in these Terms excludes or limits liability or rights that cannot legally be excluded or limited.
20. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.
21. Changes to These Terms
311 Vault may update these Terms from time to time.
Any revised Terms will become effective when posted on the website unless a different effective date is stated.
Changes to these Terms will apply prospectively to purchases made after the revised Terms become effective and will not retroactively alter the terms applicable to previously completed purchases unless required by applicable law.
